1. Overview
Welcome to Learning Ability ("the Platform"). These terms ("Terms") govern your use of our interactive storytelling platform that combines Choose Your Own Adventure narratives with on-device AI-generated visuals.
By accessing or using the Platform, you agree to be bound by these Terms and our Privacy Policy. If you disagree with any part of the agreement, you may not use the Platform.
2. License to Use
Learning Ability grants you a personal, non-exclusive, non-transferable, royalty-free license to use the Platform for your own non-commercial purposes. This includes:
- Playing published adventures and making decisions at branching points
- Saving and resuming your progress across sessions
- Creating your own adventures (if you have an account)
You may not reverse engineer, decompile, or attempt to extract the source code of the Platform.
3. User-Generated Content
When you create adventures on the Platform, you retain ownership of the content you contribute (text, images, etc.). By submitting content, you grant Learning Ability a worldwide, non-exclusive, royalty-free license to host, display, and distribute that content as part of the Platform.
You represent and warrant that:
- You own or have the necessary rights to all content you submit
- Your content does not violate any laws or third-party rights
- Your content does not contain malware, viruses, or any harmful code
- You are at least 13 years old (or the minimum age in your jurisdiction)
Learning Ability reserves the right to remove any content that violates these terms or our community standards.
4. Your Account
You are responsible for maintaining the security of your account, password, and any activity that occurs under them. You agree to notify us immediately of any unauthorized use of your account.
Account information you provide must be accurate, complete, and up-to-date. You may update your information at any time via the Profile page.
We reserve the right to suspend or terminate your account for violations of these Terms or unacceptable use of the Platform.
5. Advertising and Sponsorship
The Platform may display advertisements, sponsored content, and third-party integrations. We do not endorse, and are not responsible for, any third-party content.
Advertising revenue may support the ongoing development of the Platform. We reserve the right to modify, remove, or add advertising elements at our discretion.
6. Changes to the Terms
We may update these Terms from time to time. When we do, we'll post the new version on this page with an updated "Last updated" date. Material changes will also be communicated via email or an in-app notice.
Continued use of the Platform after changes signifies your acceptance of the new Terms.
7. Termination
We may terminate or suspend your access to the Platform immediately, without prior notice, for causes including breach of these Terms, fraud, abuse, or technical problems. Upon termination, your right to use the Platform ends immediately.
8. Disclaimer of Warranties
The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, secure, or that defects will be corrected.
9. Limitation of Liability
To the fullest extent permitted by law, Learning Ability shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the Platform, including loss of data, profits, or business interruption.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Learning Ability is based, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Platform shall be resolved through binding arbitration.
